Sakura is a food ordering and delivery platform operated by ENGLISH MONSTR, TOO, a company registered in the Republic of Kazakhstan.

By creating an account, accessing, browsing, or using Sakura, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service.
If you do not agree with these Terms, you must discontinue use of Sakura.
2. ELIGIBILITY
You must be at least 18 years old to create an account and place orders through Sakura.
If local law permits minors to use the platform with parental consent, the parent or legal guardian assumes responsibility for all activity performed through the account.
You represent and warrant that:
• You have legal capacity to enter into binding agreements.
• The information you provide is accurate and complete.
• You will comply with all applicable laws and regulations.
3. ACCOUNT REGISTRATION
To access certain features of Sakura, users may be required to create an account.
You agree to:
• Provide accurate information.
• Keep information up to date.
• Maintain the security of your account.
• Protect your authentication credentials.
• Notify Sakura immediately of unauthorized access.
You remain responsible for all activity performed through your account.
4. ORDERS
Sakura provides technology services that allow users to browse menus, place orders, make payments, and receive deliveries from participating restaurants.
Submitting an order does not guarantee acceptance.
Restaurants may reject or cancel orders due to:
• Product unavailability.
• Restaurant capacity limitations.
• Pricing errors.
• Technical issues.
• Suspected fraud.
• Operational reasons.
All prices displayed within Sakura are subject to change without prior notice.
5. PAYMENTS
Payments may be processed through authorized third-party payment service providers.
By placing an order, you authorize Sakura and its payment partners to charge the selected payment method.
Sakura does not store full payment card information.
Additional payment conditions are described in the Payment Terms document.
6. DELIVERY SERVICES
Delivery services may be performed by Sakura, third-party logistics providers, independent couriers, restaurant staff, or other authorized delivery partners.
Delivery estimates are approximate and are provided for informational purposes only.
Factors affecting delivery times include:
• Restaurant preparation times.
• Weather conditions.
• Traffic conditions.
• Road closures.
• Courier availability.
• Technical issues.
Sakura does not guarantee specific delivery times.
7. RESTAURANT RESPONSIBILITIES
Restaurants are independent businesses operating through the Sakura platform.
Restaurants are solely responsible for:
• Food quality.
• Ingredients.
• Product descriptions.
• Nutritional information.
• Allergen information.
• Food preparation.
• Food safety compliance.
• Packaging quality.
Sakura does not manufacture, prepare, package, or inspect food products.
To the extent permitted by law, Sakura shall not be liable for restaurant-provided product defects, food safety incidents, allergic reactions, inaccurate menu information, or restaurant operational failures.
8. COURIER RESPONSIBILITIES
Couriers and delivery providers may operate independently from Sakura.
Couriers are responsible for:
• Safe transportation of orders.
• Compliance with traffic regulations.
• Delivery execution.
Sakura acts as a technology platform facilitating delivery coordination.
9. LOYALTY PROGRAM
Sakura may offer loyalty points, rewards, promotional benefits, and similar incentives.
Unless explicitly required by law:
• Loyalty points have no cash value.
• Loyalty points are non-transferable.
• Loyalty points cannot be exchanged for money.
• Loyalty benefits may be modified or discontinued at any time.

10. ACCOUNT DELETION
Users may request account deletion through Sakura’s account settings or by contacting customer support.
Following deletion requests:
• Personal data may be deleted.
• Certain records may be retained where required by law.
• Transaction history may be retained for accounting, legal, tax, fraud prevention, dispute resolution, and regulatory compliance purposes.
Deletion of an account may result in permanent loss of loyalty points, rewards, preferences, and account history.
11. ACCEPTABLE USE
Users may not:
• Submit fraudulent orders.
• Abuse customer support.
• Abuse restaurants.
• Abuse couriers.
• Use stolen payment methods.
• Manipulate promotions.
• Exploit software vulnerabilities.
• Attempt unauthorized access.
• Reverse engineer the platform.
• Use automated systems to interfere with operations.
• Upload malicious software.
• Engage in illegal activity.
12. FRAUD PREVENTION
Sakura reserves the right to investigate activity that appears fraudulent, abusive, suspicious, or harmful.
Actions may include:
• Order cancellation.
• Loyalty point removal.
• Payment verification.
• Temporary suspension.
• Permanent account termination.
• Reporting to relevant authorities where legally required.
13. INTERNATIONAL DATA TRANSFERS
Sakura may utilize third-party infrastructure providers, including cloud hosting, analytics, communications, and payment service providers located in multiple jurisdictions.
By using Sakura, you acknowledge that information may be processed, stored, or transferred outside the Republic of Kazakhstan in accordance with applicable laws and our Privacy Policy.
14. SANCTIONS AND RESTRICTED USE
Users may not use Sakura in violation of:
• Economic sanctions.
• Export control laws.
• Trade restrictions.
• Applicable national or international regulations.
Sakura reserves the right to restrict service where required by applicable law.
15. INTELLECTUAL PROPERTY
The Sakura platform, including but not limited to:
• Software.
• Source code.
• Designs.
• Trademarks.
• Logos.
• Branding.
• Content.
• Loyalty systems.
• User interfaces.
are owned by ENGLISH MONSTR, TOO or its licensors and are protected by applicable intellectual property laws.
No rights are granted except as expressly stated in these Terms.
16. DISCLAIMER OF WARRANTIES
The Sakura platform is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, Sakura disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, availability, and non-infringement.
17. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
• Sakura shall not be liable for indirect, incidental, consequential, punitive, or special damages.
• Sakura shall not be liable for loss of profits, business interruption, loss of data, or loss of goodwill.
In any event, Sakura’s total liability shall not exceed the value of the order giving rise to the claim.
18. INDEMNIFICATION
You agree to indemnify and hold harmless Sakura, ENGLISH MONSTR, TOO, its officers, employees, contractors, and affiliates from claims, liabilities, damages, losses, and expenses arising from:
• Your use of the platform.
• Your violation of these Terms.
• Your violation of applicable laws.
• Your infringement of third-party rights.
19. CHANGES TO THESE TERMS
Sakura may update these Terms periodically.
Updated versions become effective upon publication within the application or on associated websites.
Continued use of Sakura constitutes acceptance of the revised Terms.
20. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by the laws of the Republic of Kazakhstan.
Any dispute arising from or relating to Sakura shall be subject to the jurisdiction of the competent courts of the Republic of Kazakhstan unless otherwise required by applicable law.
